The Patent Office of Georgia completed registration of trademarks «Stolichnaya» (Certificate No. M 35110) and «Ñòîëè÷íàÿ» (Certificate No. M 35112) in the name of Federal Treasure Enterprise Sojuzplodoimport on February 23, 2022.
In July 2018 Federal Treasure Enterprise Sojuzplodoimport initiated activities to register trademarks containing the word elements «Stolichnaya»/«Ñòîëè÷íàÿ» in the territory of Georgia. The enterprise filed applications for registration of trademarks with the Patent Office of Georgia, and at the same time, brought a lawsuit to cancel the national and international registrations of the trademark «Stolichnaya» owned in Georgia by ZHS IP Worldwide Sàrl (a subsidiary of SPI Group). The applications were suspended pending the outcome of the lawsuit.
Three years later Federal Treasure Enterprise Sojuzplodoimport gained a confident victory in all judicial instances of Georgia, having achieved cancellation of the registrations of the trademark «Stolichnaya», belonging to ZHS IP Worldwide Sàrl, as misleading the consumer about the origin of goods. On July 5, 2021 a final decision of the Supreme Court of Georgia came into force, which removed the main obstacles to registration of trademarks in the name of Sojuzplodoimport.
On August 25, 2021, the Patent Office of Georgia made a positive decision on the applications of Sojuzplodoimport. SPI Group’s companies tried to appeal the decision, but the Patent Office of Georgia left the appeal without consideration and in February 2022 issued certificates for the trademarks «Stolichnaya» and «Ñòîëè÷íàÿ», registered in class 33 of the International Classification of Goods and Services, to Federal Treasure Enterprise Sojuzplodoimport.
Federal Treasure Enterprise Sojuzplodoimport already supplies genuine Russian vodka «Stolichnaya» to Georgia and is taking measures to eliminate counterfeit products from the market.
Federal Treasury Enterprise «Sojuzplodoimport», established by the Order of the Government of the Russian Federation dated December 29, 2001 ¹ 1741-r, is owner of more than 140 trademarks for alcoholic, spirit-based and food products («Stolichnaya», «Moskovskaya», «Russkaya», «Sovetskoe», «Sibirskaya», «Starka» etc.) and the appellation of origin «Russian Vodka».
